Using A Mobile Telephone Whilst Driving

This offence can be committed by somebody driving a motor vehicle whilst using a hand held mobile telephone. It can also cover somebody supervising a learner driver using a mobile telephone or by somebody causing a driver to use one.

For a prosecution to be successful it would have to be shown that the mobile telephone in question was in use. It is a defence to show that the call was an emergency one and that the need for it was so pressing that the driver could not stop.
